• Business intelligence implementation and support
• Training and enablement services

Important: All consulting engagements are governed by separate written service agreements. These Terms govern your use of our website and general interactions with our Company. Specific services, deliverables, pricing, and terms will be outlined in individual service agreements executed between you and the Company.

Acceptable Use Policy

When using our Services, you agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Use the Services for any illegal, fraudulent, or malicious purpose
• Transmit viruses, malware, or other harmful code

• Third-party software and services beyond our control

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL TAPESTRIES GROUP, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use
• Business interruption or loss of goodwill
• Cost of procurement of substitute services
• Any other intangible losses

ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

AGGREGATE LIABILITY CAP: Our total liability to you for all claims arising out of or related to these Terms or the Services, whether in contract, tort, or otherwise, shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $500, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless Tapestries Group, its affiliates, and their respective officers, directors, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit or provide through the Services.

Third-Party Services and Links

Our Services may integrate with or link to third-party websites, services, or resources, including but not limited to:

• Microsoft Power BI and Microsoft Fabric platforms
• Analytics and tracking services (Google Analytics, HubSpot, Microsoft Clarity)
• Other third-party tools and technologies

We are not responsible for and do not endorse the content, products, services, or practices of any third parties. Your use of third-party services is at your own risk and subject to their respective terms and privacy policies. We encourage you to review the terms of any third-party services you access through our Site.

Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent, abusive, or illegal activity

• Discontinuation of the Services

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the federal or state courts located in Dane County, Wisconsin. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any separate service agreements, constitute the entire agreement between you and Tapestries Group regarding your use of the Services and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, government actions, internet service failures, or other force majeure events.
